Third Party Liability

Third-Party Liability Lawyer in Indianapolis

Nearly 30 Years Handling Workers’ Compensation & Personal Injury Claims

A job injury may support more than a workers’ compensation claim when someone outside your employer contributed to the accident. A contractor, property owner, equipment manufacturer, vendor, delivery company, or driver may bear separate legal responsibility for your losses.

At Leonard Law Group, we handle both workers’ compensation and personal injury matters, so we can examine how the two claim paths may interact. Our experience can help us identify potentially responsible parties before evidence disappears or legal deadlines pass.

When Someone Else May Be Liable for Your Work Injury

Liability depends on who controlled the work area, supplied the equipment, created the hazard, or assumed contractual safety responsibilities. Establishing a claim also requires evidence connecting that person or business to the accident and your injuries.

Potentially responsible third parties may include:

  • General contractors whose conduct or site responsibilities contributed to unsafe working conditions.
  • Subcontractors whose employees, equipment, or work created a hazard.
  • Property owners responsible for dangerous premises conditions.
  • Manufacturers or suppliers connected to defective machinery, tools, or safety equipment.
  • Drivers or delivery companies involved in work-related traffic or loading accidents.
  • Vendors whose actions contributed to an incident at the jobsite.

A supervisor or coworker isn’t automatically a third party simply because that person was involved in the accident. Employment relationships, contractual roles, and Indiana law must be examined before liability can be determined.

How Third-Party Claims Interact With Indiana Workers’ Compensation

Workers’ compensation generally addresses employment-related medical care and wage benefits. A separate personal injury case requires proof under negligence, premises liability, or product liability law. If successful, it may provide compensation for additional losses recognized under Indiana law, such as pain and suffering, diminished quality of life, or reduced future earnings.

Although both proceedings may arise from the same accident, they remain legally distinct. They can require different evidence, insurers, negotiations, litigation procedures, and settlement decisions.

Liens, Reimbursement, & Subrogation

Benefits paid through workers’ compensation may create an employer or insurer lien against a recovery from a responsible third party. The insurer may have a right to reimbursement for certain medical expenses, wage benefits, or other payments. Because these rights can affect how a settlement or judgment is distributed, both cases should be evaluated together before you accept an offer.

Indiana Filing Deadlines

Indiana law generally gives an injured employee two years from the injury to institute a third-party action. The applicable deadline may depend on the facts, the defendant’s identity, and other legal rules. Workers’ compensation disputes follow separate procedures through the Indiana Workers’ Compensation Board, so pursuing one path doesn’t automatically preserve the other.

Evidence That Can Identify Every Responsible Party

Documenting the accident is only part of the investigation. Contracts, ownership records, equipment files, and jobsite responsibilities may show that another business controlled the condition or activity that caused your injury.

Relevant evidence may include:

  • Accident and incident reports.
  • Medical records and treatment documentation.
  • Photographs or video of the scene, equipment, and injuries.
  • Names and contact information for witnesses.
  • Equipment manuals, maintenance records, and product information.
  • Contracts, safety materials, and worksite policies.
  • Employment and wage records.
  • Letters, emails, and statements from employers or insurers.

Preserve the documents, photographs, and communications already in your possession. Don’t settle either case before understanding how that decision could affect your benefits, potential recovery, and reimbursement obligations.

Direct Partner Involvement Across Both Claim Paths

At Leonard Law Group, the partner you initially retain remains directly involved rather than passing your case from associate to associate. This continuity gives you a consistent point of contact as we evaluate workers’ compensation benefits, third-party liability, damages, and reimbursement issues.

We’ve recovered more than one billion dollars for clients across our practice. That figure reflects historical results and doesn’t guarantee or predict the outcome of any individual case.

Get a Fact-Specific Review of Your Work Injury

Contact us and share any documents you have about the accident and your treatment, including records that identify your employer and other involved parties. We can assess whether the facts warrant investigating a separate personal injury case and explain how it may interact with your workers’ compensation benefits.
