Overtime & Workers’ Compensation in Indianapolis

Recurring Overtime May Affect Your Indiana Workers’ Compensation Benefits

If you regularly worked overtime before a workplace injury, you may question whether those earnings were properly reflected in your workers’ compensation benefits. At Leonard Law Group, we examine your earnings history, overtime pattern, and the wage records submitted by your employer or insurance carrier.

A benefit calculation dispute isn’t the same as an unpaid overtime claim. Wage-and-hour law addresses whether an employer paid required overtime. Indiana workers’ compensation law governs income benefits after a workplace injury.

How Overtime May Factor Into Your Average Weekly Wage

Average weekly wage is used to calculate certain workers’ compensation benefits. Under Indiana law, it is generally based on earnings during the relevant 52-week period before the injury. The appropriate calculation may vary with your employment history and the facts of your claim.

Temporary total disability benefits may replace part of your wages while an injury prevents you from working. These benefits are generally calculated at two-thirds of the average weekly wage, subject to eligibility requirements and statutory limits. Recurring overtime may affect the underlying wage figure, but the treatment of specific payments depends on Indiana law and the available records.

Workers’ compensation calculations don’t automatically apply the federal overtime rate to every extra hour. Federal wage-and-hour rules and workers’ compensation benefit rules serve different purposes, even when both involve overtime earnings.

Evidence That Can Clarify an Overtime Benefit Dispute

A dispute may arise when pay stubs show regular overtime, but the wage figure reported to the workers’ compensation insurance carrier doesn’t appear to include those earnings. Questions can also result from irregular schedules, seasonal changes, missing payroll periods, or disagreement over whether extra compensation was recurring.

Records that may help establish your wage history include:

  • Pay statements: Documents showing regular wages, overtime hours, overtime pay, and other compensation.
  • Payroll and time records: Employer records identifying hours worked and payments issued before the injury.
  • Work schedules: Calendars or schedules showing whether overtime occurred consistently or occasionally.
  • Tax documents: Wage statements that may help confirm annual earnings.
  • Benefit notices: Documents identifying the wage figure and benefit amount used by the employer or insurance carrier.
  • Employment agreements: Written terms addressing compensation, schedules, or expected hours.

The strength of a claim depends on your earnings history, the nature of the payments, the period covered by the records, and the governing Indiana rules. One pay stub with a higher total may not establish a recurring pattern, so the complete record matters.

Partner-Led Representation for Injured Indiana Workers

Leonard Law Group has represented injured clients since 1996. We handle workers’ compensation and personal injury cases in Illinois and Indiana and have recovered more than one billion dollars for clients across our practice.

When a dispute involves overtime, we focus on the figures and records behind the benefit calculation. We may compare your pay history with reported wages, review communications from the employer or carrier, and identify omitted periods or compensation that require closer examination.

The partner you initially retain remains involved throughout your case instead of transferring responsibility among associates. You maintain direct communication with that partner from the initial evaluation and investigation through representation.

We can assess your injury and work status, wage history, current benefit amount, and any explanation provided for the calculation. Depending on the circumstances, we may gather additional records, seek an adjustment, or prepare a formal dispute. An Application for Adjustment of Claim is used to bring a disputed matter before the Indiana Workers’ Compensation Board. Whether that filing or another step is appropriate depends on the status and facts of your claim.

Request a Review of Your Indianapolis Benefit Calculation

If you believe recurring overtime or other earnings weren’t fully considered, bring any available pay stubs, benefit notices, schedules, and carrier correspondence to your consultation. We can review your wage history and explain the options that may apply to your workers’ compensation claim.

We offer free initial consultations and contingency-based representation, giving you an opportunity to understand the disputed calculation before deciding how to proceed.
